BRICS Environment Ministers oppose EU's Carbon Border Tax
The EU's Carbon Border Adjustment Mechanism is a trade-environment measure with direct implications for Indian exports like steel, aluminium, and fertilizers. BRICS nations collectively opposing it signals a developing-world pushback against what they see as 'green protectionism', which is central to climate justice debates in GS III and GS II international relations. This also touches on WTO compatibility, UNFCCC principles (Common But Differentiated Responsibilities), and North-South climate equity tensions.
Key facts
- BRICS Environment and Climate Ministers collectively termed CBAM 'unilateral, punitive, discriminatory and protectionist' — not in line with international law.
- EU's CBAM imposes a carbon price on imports of carbon-intensive goods (steel, cement, aluminium, fertilizers, electricity, hydrogen) from non-EU countries.
- CBAM transitional phase ran from October 2023; full implementation begins January 2026.
- BRICS nations — Brazil, Russia, India, China, South Africa (plus newer members) — are major exporters of carbon-intensive goods affected by CBAM.
- Critics argue CBAM violates WTO's Most Favoured Nation (MFN) and non-discrimination principles.
- CBAM contradicts UNFCCC's principle of Common But Differentiated Responsibilities and Respective Capabilities (CBDR-RC), which exempts developing nations from equal carbon obligations.
BRICS ENVIRONMENT and climate ministers Tuesday opposed the European Union's (EU) Carbon Border Adjustment Mechanism (CBAM) or Carbon Border Tax, calling it a unilateral, punitive, discriminatory and protection measure that is not in line with international law.
Concepts to know
An EU trade policy tool that imposes a carbon price on imports of carbon-intensive products to prevent 'carbon leakage' — where companies shift production to countries with weaker climate rules. It effectively equalises carbon costs between EU and non-EU producers.
A foundational UNFCCC principle acknowledging that developed nations bear greater historical responsibility for climate change and must take the lead in mitigation, while developing nations have differentiated obligations. CBAM is seen as undermining this principle.
A grouping of major emerging economies (Brazil, Russia, India, China, South Africa, plus new members like UAE, Ethiopia, Iran, Egypt). It represents a significant share of global GDP and trade; its positions carry weight in global governance negotiations.
A WTO principle requiring that trade advantages granted to one nation must be extended to all WTO members equally. CBAM critics argue it discriminates against developing nations whose carbon pricing regimes differ from the EU's.
The phenomenon where businesses relocate production to countries with less stringent climate regulations to avoid carbon costs, effectively undermining the emission-reduction goals of stricter jurisdictions. CBAM is designed to counter this.
United Nations Framework Convention on Climate Change — the primary international treaty governing global climate action, under which the Paris Agreement was adopted. It enshrines the CBDR-RC principle that BRICS invokes against CBAM.
